Atlas Beta Trial Terms

1. What these terms are

These Atlas Beta Trial Terms apply on top of the existing Atlas Terms & Conditions (Main Terms) and only when you have actively opted in to the Atlas Beta Trial.

The Atlas Beta Trial is an early-access version of the new and improved Atlas that lets you try features still in active development. This page explains how the Atlas Beta Trial works, what to expect, and what you're agreeing to when you take part.

If you have not opted in: these Beta Trial Terms do not apply. The Main Terms continue unchanged.

If you have opted in: these Beta Trial Terms sit alongside the Main Terms. Where the two say different things, these Beta Trial Terms apply for as long as you are in the Atlas Beta Trial. You can leave at any time (see Section 7).

2. What the Atlas Beta Trial is

The Atlas Beta Trial gives you early access to features that are still being built and refined — for example, face, place, and moment search; transcription; community sharing; and FACTI.

The Atlas Beta Trial is available across both:

  • The Atlas web platform at beta.atlasarchive.org; and
  • The Atlas mobile apps for iOS (via the Apple App Store) and Android (via Google Play).

Opting in to the Atlas Beta Trial covers all surfaces where you sign in with the same Atlas account.

Because these features are in active development:

  • They may change, move, or be removed without notice.
  • You may see bugs, slow performance, or short periods where features don't work as expected.
  • New features may appear, and existing ones may behave differently from one week to the next.
  • We may invite you to give feedback or take part in optional research.

The Atlas Beta Trial is provided so you can explore what's coming and help shape it — not as a finished product.

3. No service guarantees (during the Atlas Beta Trial)

Atlas Beta Trial features are provided "as is" and "as available". For the duration of the trial:

  • We do not commit to any uptime, performance, or response-time guarantees for the Atlas Beta Trial features.
  • Processing of media (e.g. transcription, face grouping, search indexing) may be delayed, paused, or re-run as we improve the system.
  • Data Atlas generates from your media (tags, transcripts, face groupings) may be reset, regenerated, or restructured during the trial.

Your original files are not affected by any of this during the Atlas Beta Trial — see Section 6.

4. Changing or ending the Atlas Beta Trial

You can leave the Atlas Beta Trial at any time, for any reason — see Section 7 for how that works and what happens to your data.

We may also:

  • Add, change, or remove Atlas Beta Trial features at any time.
  • End your access to the Atlas Beta Trial, or end the Atlas Beta Trial programme as a whole, at our discretion.
  • Limit the Atlas Beta Trial to certain users, regions, or use cases.
  • For mobile users: change app-store availability (Apple App Store, Google Play) during the trial. You may be required to update to the latest version of the Atlas mobile app to continue taking part, and we may temporarily or permanently withdraw the app from a store.

Wherever reasonably possible, we'll give you advance notice of significant changes — but we can't always guarantee it during a trial.

5. Feedback

If you send us feedback, suggestions, ideas, or bug reports about the Atlas Beta Trial (Feedback), you grant us irrevocable licence to use that Feedback to improve Atlas and our other products and services, without restriction or any obligation to compensate you.

You don't have to send Feedback. If you do, please don't include anything you consider confidential.

6. Your original files during the Atlas Beta Trial

While you are in the Atlas Beta Trial, your original uploaded files are treated the same as any other content on Atlas:

  • They are stored, backed up, and protected under the Main Terms and the Atlas Hosting Privacy Policy.
  • They are not changed, degraded, or deleted by Atlas Beta Trial features going wrong, changing, or being withdrawn.
  • You can download your archive at any time.

If you choose to leave the Atlas Beta Trial or close your Atlas account during the trial, the deletion process described in Section 7 applies.

Please note: this protection applies for the duration of the Atlas Beta Trial. What happens to your original files when the trial concludes is described in Section 8.

7. Leaving the Atlas Beta Trial or closing your account

You can leave the Atlas Beta Trial at any time:

  • Opt out of the Atlas Beta Trial (keep your original Atlas account): for the duration of the trial, you can continue using your existing Atlas account under the Main Terms only. Atlas Beta Trial features, and any data Atlas generated from them (such as tags, transcripts, or face groupings), may be removed from your account when you opt out.
  • Close your Atlas account: your account will be closed under our standard account-closure and deletion process, as described in the Main Terms and the Atlas Hosting Privacy Policy. You will be given a reasonable window to download your archive before deletion.

Uninstalling the Atlas mobile app does not on its own opt you out of the Atlas Beta Trial or close your account — your account, your original files, and any Beta Trial data remain in place. To opt out or close your account, follow the steps above or contact us at app@atlasarchive.org.

Please note that the ability to opt out and return to your existing Atlas account is only available while the Atlas Beta Trial is running. The current hosting version of Atlas will not remain available indefinitely. What happens when the Atlas Beta Trial ends is covered in Section 8.

8. When the Atlas Beta Trial ends

The Atlas Beta Trial runs for a limited period. When it ends, these Beta Trial Terms stop applying.

We'll tell you in advance when the Atlas Beta Trial is coming to an end, and we'll share information at that point about what happens next — including any updated terms and the options available to you.

These Beta Trial Terms do not commit us to any particular end date, launch date, pricing, or feature set for what comes after the Atlas Beta Trial.

9. Liability

Atlas Beta Trial features are experimental. To the fullest extent permitted by law:

  • Atlas and EachMoment are not liable for any loss, damage, or inconvenience caused by Atlas Beta Trial features failing, behaving unexpectedly, or being changed or withdrawn.
  • Our overall liability to you in connection with the Atlas Beta Trial is limited to the limits already set out in the Main Terms.
  • Nothing in these Beta Trial Terms limits any liability that cannot be limited under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud).

Your statutory rights as a consumer are not affected.

11. App Store terms (mobile users)

If you access the Atlas Beta Trial through the Apple App Store:

  • These Beta Trial Terms are an agreement between you and EachMoment Ltd only, and not with Apple Inc. (Apple). EachMoment, not Apple, is solely responsible for the Atlas mobile app and its content.
  • Apple has no obligation to provide any maintenance or support services for the Atlas mobile app.
  • In the event of any failure of the Atlas mobile app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever in respect of the app.
  • EachMoment, not Apple, is responsible for addressing any claims relating to the Atlas mobile app, including (but not limited to) product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.
  • EachMoment, not Apple, is responsible for the investigation, defence, settlement, and discharge of any third-party intellectual-property infringement claim relating to the Atlas mobile app.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo (or designated by the U.S. Government as a "terrorist supporting" country) and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Beta Trial Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Beta Trial Terms against you as a third-party beneficiary.

If you access the Atlas Beta Trial through Google Play:

  • Your use of the Atlas mobile app is also governed by the Google Play Terms of Service and the Google Play distribution terms applicable to you. EachMoment, not Google, is responsible for the Atlas mobile app and any support, claims, or warranties relating to it.

12. Acknowledgement

By opting in, you confirm: I've read these Atlas Beta Trial Terms and I understand that Atlas Beta Trial features are still in development, may change or be withdrawn, and are provided without service guarantees. I agree to take part in the Atlas Beta Trial on this basis.
