Terms & Conditions

The agreement between you and EachMoment Ltd when you create an Atlas account, store media with us, or pay for a subscription.

1. Who we are

EachMoment Ltd (Company No. 12143457), 8 City Road, Norwich, England, NR1 3AL ("EachMoment", "we", "us") operates the Atlas platform — the iOS and Android apps, the websites at atlasarchive.organd beta.atlasarchive.org, and the supporting backend services (collectively, "Atlas").

By creating an account, ticking the consent checkbox at sign-up, or otherwise using Atlas, you agree to these Terms.

2. Your account

  • You must be at least 16 years old to create an Atlas account.
  • You're responsible for keeping your sign-in details secure. Tell us straight away at app@atlasarchive.org if you think someone else has accessed your account.
  • One person per account. Family members or co-archivists can be invited via the sharing features inside Atlas — please don't share your password.
  • We may suspend or close an account that is used to abuse Atlas, store unlawful content, or breach these Terms.

3. Atlas Lite, Atlas Archive, Atlas Beta

Atlas is sold in tiers. Each has its own scope:

  • Atlas Lite — — secure hosting of the photos, videos and audio you sent us to digitise (or that you upload directly). Browse, watch, download, share via private links. No automated content processing of any kind. See the Privacy Policy §3.3.
  • Atlas Archive — — everything in Atlas Lite, plus opt-in AI features (face search, places, timelines, AI-built stories). Launching 26 June 2026. The AI processing is governed by the AI Indexing Addendum.
  • Atlas Beta — — the experimental programme; additional terms in the Beta Trial Terms.

4. Your media

Anything you upload to Atlas remains yours. You give us a limited, non-exclusive licence to store, transmit, process and serve your media back to you (and to anyone you've shared with via Atlas's sharing features), strictly to provide the service. We don't use your media to train AI models we don't control, we don't sell it, and we don't show it to advertisers.

You promise that you have the right to upload everything you upload — for example, that you are the photographer or videographer, or that the person who created the media has given you permission to store and (where applicable) share it.

5. Acceptable use

You may not use Atlas to:

  • store or share content that is unlawful, infringes someone else's rights, or that you don't have permission to store;
  • upload child sexual abuse material, content depicting non-consensual sexual acts, or terrorist content — accounts identified as doing so are suspended immediately and reported to the relevant authorities;
  • attempt to bypass security, scrape data en masse, or otherwise interfere with the service;
  • reverse engineer the service for the purpose of building a competing product.

6. Subscriptions, pricing, billing

  • Pricing. The price you are quoted at sign-up is the price you pay until you cancel. If we change pricing for new customers, your existing subscription stays on the rate you agreed to ("locked-in rate"), unless we explicitly notify you in writing 30 days in advance.
  • Billing. Stripe processes payments on our behalf. We never see or store your card details. Your billing cycle is monthly or annual depending on the plan you picked.
  • Renewals. Subscriptions renew automatically at the end of each cycle. We email you in advance of any annual renewal.
  • VAT. Prices are inclusive of UK VAT where applicable.

7. Cancellation, refunds, what happens to your archive

  • Cancel any time. Use the cancel link inside the Stripe Customer Portal, or email app@atlasarchive.org. Cancellation takes effect at the end of the current billing period; you keep access until then.
  • Refunds. We don't routinely refund partial periods (you've had access for the time you paid for). If something has gone wrong and you'd like a refund, email app@atlasarchive.org and we'll look at it case-by-case.
  • Download your archive. You can request a full export of your media at any time from inside Atlas. Within the first 30 days of joining Atlas Lite (the preview window), the export is free; afterwards, it's free for active subscribers and free for 30 days after a cancellation.
  • Inactive accounts. If your subscription lapses, we keep your archive for as long as we reasonably can. We reserve the right to remove archives from inactive accounts to manage operational costs, with at least 30 days' written notice by email before removal. See Privacy Policy §8.

8. Changes to these Terms

We may update these Terms when the service changes, when the law changes, or when we add new features. We'll let you know about material changes — by email, by an in-product notice, or by asking you to re-tick the consent checkbox at next sign-in. Continued use of Atlas after a material change means you accept the updated Terms; if you don't accept, cancel and request an export inside the 30-day window per Section 7.

9. Liability

We do everything we reasonably can to keep your archive safe — TLS in transit, encryption at rest where feasible, two-data-centre mirroring, and regular backups. But:

  • To the maximum extent allowed by law, Atlas is provided "as is" and we don't promise that the service will be uninterrupted or error-free.
  • We're not liable for loss of profits, loss of business, loss of goodwill, or indirect or consequential loss.
  • Our total liability to you in any 12-month period is capped at the amount you paid us for Atlas in that period (or £100 if more, for Lite customers).
  • Nothing in these Terms limits our liability for death, personal injury caused by our negligence, or fraud, or for anything else where liability cannot be limited under English law.

10. Suspension and termination

We may suspend or close your account if you breach these Terms, if we're required to do so by law, or if your continued use poses a serious risk to other users or the service. Where reasonably possible, we'll give you advance notice and the opportunity to fix the issue. You can close your account at any time from inside Atlas, or by emailing app@atlasarchive.org.

11. Governing law

These Terms are governed by the laws of England and Wales. Disputes that can't be resolved directly with us will be heard exclusively by the courts of England and Wales, except where you are a consumer in another part of the UK or EU and the law of that jurisdiction grants you the right to bring proceedings in your home courts.
